End-User License Agreement & Terms of Sale — Dustly

By downloading, activating, or using Dustly (the "Software"), you agree to these terms. If you do not agree, do not use the Software.
1. License grant
We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use the Software on up to 3 Mac(s) that you own or control, for your own use, subject to these terms.
2. Trial
The Software may be used free for a 7-day trial, during which all features are available. When the trial ends, a valid license is required to continue using cleanup and deletion features (moving removed items to the macOS Trash). Scanning, disk analysis, and viewing results remain free at all times.
3. Restrictions
You may not: (a) resell, rent, sublicense, or redistribute the Software or license keys; (b) reverse engineer, decompile, or disassemble it except where that restriction is prohibited by law; (c) remove proprietary notices; (d) share your license key publicly or circumvent licensing/activation; (e) use the Software unlawfully.
4. Payment, Merchant of Record, and taxes
Purchases are processed by Lemon Squeezy, acting as the Merchant of Record for the sale. Your purchase is also subject to Lemon Squeezy's terms at checkout. Lemon Squeezy handles billing, applicable taxes/VAT, and payment processing. Prices are shown at checkout and may change for future purchases.
5. Refunds
We offer a 14-day refund. To request one, email support@dustly.app with your order number and the email address used for the purchase. Refunds are issued through Lemon Squeezy. If you are an EU/EEA consumer, you normally have a 14-day right of withdrawal for online purchases. Because the license is digital content supplied without a physical medium, this right may not apply once supply has begun with your consent: by purchasing a license and activating it you request immediate access and acknowledge that you thereby lose the statutory right of withdrawal. This does not affect the voluntary refund described above or any mandatory consumer rights that cannot be waived under your local law.
6. No warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Software will be error-free or uninterrupted.
You are responsible for maintaining current backups of your data. The Software moves removed items to the macOS Trash so they can be restored before you empty it, but you use cleanup and deletion features at your own risk.
7. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Software. Our total aggregate liability for any claim relating to the Software will not exceed the amount you paid for it in the 12 months before the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited by law (e.g. for gross negligence or willful misconduct).
8. Updates
We may provide updates that fix, change, or remove features. These terms apply to updates unless the update includes separate terms.
9. Termination
This license ends automatically if you breach these terms. On termination you must stop using and delete the Software. Sections 6–7 and 10 survive termination.
10. Governing law
These terms are governed by the laws of France, without regard to conflict-of-law rules. Disputes will be subject to the courts of France, unless mandatory consumer-protection law in your country of residence provides otherwise.
